You and BMRG agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Site (collectively, "Disputes") shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties, or if the parties cannot agree, selected in accordance with the AAA Commercial Arbitration Rules. The seat of arbitration shall be Raleigh, North Carolina. The arbitrator shall apply the substantive law of North Carolina without regard to conflicts of law principles. The arbitrator's decision shall be final and binding, and judgment on the award rendered may be entered in any court having jurisdiction thereof. Each party shall bear its own costs and attorneys' fees in connection with the arbitration, and the parties shall share equally the fees and expenses of the arbitrator and the AAA; provided, however, that the arbitrator may award costs and attorneys'; fees to the prevailing party if permitted by applicable law. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights. The parties agree to maintain the confidentiality of all aspects of the arbitration proceedings, including the existence of the arbitration, any non-public information disclosed during the proceedings, and the arbitrator's decision, except as may be required by law or to enforce the arbitration award. This arbitration agreement shall survive termination of these Terms.

15. Accessibility. BMRG is committed to providing an accessible Site for all users, including individuals with disabilities. We endeavor to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards.1 If you or any authorized user within your organization experiences difficulty accessing any functionality of this Site, please contact us at WebAccess@BMRGpro.com with a description of the accessibility issue and your preferred method of contact. BMRG will use commercially reasonable efforts to address reported accessibility concerns in a timely manner. Nothing in this Section shall be construed to create any obligation beyond what is required by applicable law.

16. Miscellaneous. These Terms contain the entire agreement between you and BMRG regarding the use of the Content and the information contained on this Site. You agree that these Terms take effect on your first use of this Site, and that they apply to all persons accessing the Site from your computer. You agree to regularly review these Terms for changes and agree to those changes by continuing to use or view this Site. Unless otherwise explicitly stated, the provisions contained herein will survive termination of your access to and use of the Content and the information contained on this Site. If any clause or provision set forth herein is determined to be illegal, invalid, or unenforceable under present or future law, then, in that event, you understand and agree that the clause or provision so determined to be illegal, invalid, or unenforceable shall be severable without affecting the enforceability of all remaining clauses or provisions. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising from or out of your use of the Site must be filed within one (1) year after such claim or cause of action arose.
